In most cases, however, the opposite applies: an employer may not simply require an employee to undergo a medical examination. The right to privacy and physical integrity is central to Dutch legislation. This article answers the most frequently asked questions about when a medical examination is or is not mandatory, what the law says, and what role the occupational physician plays.

In which situations may an employer require a medical examination?

An employer may only require a medical examination if there is a legal basis for doing so. This is the case for roles that carry direct risks to the safety of others, such as drivers, pilots, or employees who work with hazardous substances. Outside these legally defined situations, an employer has no right to compel a medical examination.

The Working Conditions Act provides the primary legal basis. Employers are required to offer employees the opportunity to participate in a Periodic Occupational Health Examination (PAGO) or a Preventive Medical Examination (PMO) when specific occupational risks are present — such as exposure to hazardous substances, high work pressure, or physically demanding work. In those cases, offering the examination is mandatory, but employee participation generally is not.

Situations in which a medical examination may be legally required:

Roles in aviation, shipping, or public transport where the safety of third parties is at stake

Working with hazardous substances for which a medical fitness certificate is legally required

Pre-employment medical assessments for specific roles with special physical or psychological demands

Re-assessment during long-term sick leave under the Gatekeeper Improvement Act (Wet verbetering poortwachter)

What does the law say about the right to privacy in medical examinations?

The law provides strong protection for employees on this point. The right to physical integrity is enshrined in Article 11 of the Dutch Constitution, and the General Data Protection Regulation (GDPR) classifies medical data as special category personal data. This means that employers may only process such data if there is an explicit legal basis for doing so.

An employer may never ask about the nature of an illness, a diagnosis, or medical details. That is not the employer's role. The occupational physician assesses the employee's functional capacity and communicates only functional limitations to the employer. The medical content remains confidential.

Employee consent is rarely a valid legal basis for processing medical data in an employment relationship. The reason: consent is not considered legally voluntary when a relationship of authority exists. An employee who says "yes" out of fear of negative consequences has not, in fact, made a free choice. The law recognises this and therefore sets higher requirements for the legal basis.

What is the difference between a PAGO, a PMO, and a pre-employment medical assessment?

The Periodic Occupational Health Examination (PAGO), the Preventive Medical Examination (PMO), and the pre-employment medical assessment are three distinct forms of medical examination, each with its own purpose, target group, and legal framework. In practice, they are regularly confused with one another.

PAGO: focused on occupational risks

The PAGO is specifically aimed at the health risks arising from the work itself. If employees are exposed to hazardous substances, noise, or other measurable risk factors, the employer is required to offer this examination. The goal is to detect occupational diseases or health damage that are directly related to working conditions at an early stage.

PMO: broader and preventive

The PMO has a broader scope. It looks not only at occupational risks, but also at the overall health and vitality of the employee. Employers are increasingly using the PMO as part of a sustainable employability policy. Participation is voluntary, unless a collective labour agreement or statutory regulation specifies otherwise.

Pre-employment medical assessment: only for specific roles

The pre-employment medical assessment takes place before a person starts a job. The Medical Examinations Act sets strict requirements: a pre-employment assessment is only permitted if the role places special demands on medical fitness that cannot be established in any other way. The employer must demonstrate in advance why the assessment is necessary.

May an employee refuse a medical examination?

In most cases, an employee may refuse a medical examination, because participation in a PAGO or PMO is in principle voluntary. In the case of a pre-employment assessment or a legally required examination for specific roles, refusal may have consequences, such as not being considered for the position or suspension of sick pay.

The nuance lies in the context. If a sick employee refuses to cooperate with an assessment by the occupational physician under the Gatekeeper Improvement Act, the employer may — after an official warning — suspend wage payments. This is not a punishment, but a legal instrument to encourage cooperation with reintegration.

Steps that apply when a legally required examination is refused:

The employer informs the employee in writing of the obligation and the consequences of refusal

The employee is given the opportunity to raise an objection or request a second opinion

If the refusal continues without valid reason, the employer may consider legal steps or suspend wage payments

An employment lawyer or the occupational physician can mediate in the event of a dispute

What role does the occupational physician play in mandatory medical examinations?

The occupational physician is the only professional authorised to carry out medical examinations in an employment context and to advise the employer on an employee's functional capacity. The occupational physician works independently: he or she has a duty of confidentiality and never communicates medical details to the employer — only functional conclusions.

In mandatory medical examinations, such as those relating to sick leave or a statutory assessment, the occupational physician holds a central position. The physician assesses whether a person is fit to work, what adjustments may be needed, and how reintegration might look. The employer receives advice, not a diagnosis.

Employees have the right to request a second opinion from another occupational physician if they disagree with the advice given. This right is enshrined in law and reinforces the independent position of the occupational physician in relation to both the employer and the employee.

How CYS Group helps measure employee wellbeing and engagement

Medical examinations are about health and fitness for work. But the underlying question is often much broader: how does an organisation know how its people are truly doing? How do you detect early on that work pressure is rising, that engagement is declining, or that absenteeism is on the horizon? That is precisely where employee satisfaction surveys play a role.

CYS Group helps organisations continuously listen to their employees, without complex methodologies or annual snapshots that are already outdated by the time they are read. With the Employee Energy Pulse (EEP) and the 3-question methodology, you can quickly and clearly map out what is happening:

How do employees currently experience their workload, vitality, and engagement?

Which drivers have the greatest influence on workplace happiness and commitment?

Where are the priorities for managers to make a real difference?

The cx.management platform translates feedback not into a pile of reports, but into concrete actions per team. Through closed-loop follow-up, every manager knows what is happening and what is expected of them. This turns listening to employees from an annual obligation into a living part of your organisation.

Want to find out how this works for your organisation? Get in touch and discover what continuous listening can mean for your people.

Make every experience count.

Frequently Asked Questions
